Giveaway Terms and Conditions — “Full Custom Kit” Giveaway

1. Organizer
The promoter of this free-to-enter giveaway (the “Giveaway”) is DISTINCT DESIGNS STUDIO, S.L., registered address Calle Mallorca 33 1o 2a, Barcelona, Cardedeu 08440, tax ID (CIF) B75970426, VAT ESB75970426, contact email info@bydistinct.com (the “Organizer”).

2. Territory, eligibility and dates
2.1 Territory: European Union. Void where prohibited.
2.2 Eligibility: Open to natural persons aged 18 or over with a genuine Instagram account. Employees of the Organizer and their immediate family are not eligible. No purchase is necessary and a purchase does not increase the chances of winning.
2.3 Dates: The Giveaway will run from [16/08/2025 23:59 Europe/Madrid] until [22/08/2025 15:00 Europe/Madrid]. Entries submitted outside this period will not be accepted.

3. Channel
The Giveaway is communicated exclusively through the Instagram account @bydistinctdesigns (the “Account”).

4. How to enter
During the entry period, participants must:
a) Follow @bydistinctdesigns;
b) Like the Giveaway post on the Account;
c) Comment on the Giveaway post answering the stated question and mention 1 friend (tag).
Optional extra entry: share the Giveaway post in Instagram Stories mentioning @bydistinctdesigns (1 additional entry).
Limits: Maximum 3 comments/entries per person (tagging different friends). Automated, duplicate, spam or fraudulent entries, fake or multiple accounts, or entries that do not comply with these Terms will be disqualified.

5. Prize
One (1) Full Semi-Custom Motorcycle Graphic Kit, with finish of the winner’s choice (e.g., Gloss or Chrome), and shipping included within the Europe. Approximate retail value (ARV): €289,99.
The prize cannot be exchanged for cash, except as provided in Clause 8 (compatibility).

6. Winner selection and alternates
6.1 On [22/08/2025], the Organizer will select 1 winner and 10 alternates at random from all valid entries using a certified random draw tool, generating a public certificate of validity accessible at: [URL to certificate will be added on 22/08/2025].
6.2 The result will be announced by a pinned comment on the Giveaway post and via Instagram Stories on the Account.
6.3 The winner must claim the prize by replying via Instagram Direct Message within 48 hours of the public announcement. If the winner does not respond in time, does not meet the requirements, or declines the prize, the prize will be offered to the first alternate, and so on until accepted.

7. Prize fulfilment
Once accepted, the Organizer will collect the winner’s details (full name, email, phone, shipping address and exact motorcycle model) and will coordinate design options within the product scope and shipping. The winner will have 60 days from acceptance to define model/design; failure to do so will be deemed a waiver, and the prize may be offered to an alternate.

8. Model compatibility (contingency clause)
If the winner’s motorcycle or helmet model is not technically feasible (e.g., no available template or incompatibility), the winner may choose one of the following alternatives:
a) a store credit equal to the ARV of the prize to redeem for other products on the Organizer’s website;
b) exchange for another available product/service of equivalent value;
c) transfer of the prize to another person designated by the winner (one time only) who has a compatible model.
If the winner rejects all alternatives, they forfeit the prize and an alternate will be contacted.

9. Publicity
The winner authorizes the Organizer to mention their Instagram handle in communications announcing the result on the Account. No further image rights assignment is required.

10. Fraud, exclusions and right to cancel
The Organizer may void entries and/or exclude participants for fraud, impersonation, breach of these Terms or bad-faith conduct. The Organizer reserves the right to modify, suspend or cancel the Giveaway for justified reasons or force majeure, without liability, provided such change is communicated on the Account.

11. Instagram release
Instagram does not sponsor, endorse or administer this Giveaway, nor is it associated with it. By participating, you release Instagram from any responsibility arising from the Giveaway. You provide your information to the Organizer, not to Instagram.

12. Data protection (GDPR)
Controller: DISTINCT DESIGNS STUDIO, S.L., info@bydistinct.com.
Purpose: managing the Giveaway (eligibility checks, contact, prize delivery) and, only if you expressly opt-in, sending marketing communications.
Legal basis: participant’s consent.
Recipients: no data will be transferred to third parties other than service providers strictly necessary to run the Giveaway (e.g., random draw/certification platform, logistics) or when legally required.
Retention: for the time strictly necessary to manage the Giveaway and for up to 6 months thereafter to evidence process integrity; winner data will be kept for the legally required periods.
Rights: access, rectification, erasure, objection, restriction and portability, by emailing info@bydistinct.com; you may also lodge a complaint with the Spanish Data Protection Agency (AEPD).

13. Taxes
The prize may constitute a taxable gain for the winner under applicable law. Where required, the Organizer may carry out the corresponding withholding or advance payment and request the personal data necessary to fulfil tax obligations. The winner is responsible for declaring the prize in their personal tax return.

14. Acceptance of Terms and governing law
Participation implies full and unconditional acceptance of these Terms. These Terms shall be governed by Spanish law. Consumers may submit any dispute to the courts of their domicile.
