1. Organizer
The organizer of this giveaway is DISTINCT DESIGNS STUDIO, S.L., registered address Calle Mallorca 33 1o 2a, Cardedeu, Barcelona 08440, Spain, tax ID (CIF) B75970426, VAT ESB75970426, contact email info@bydistinct.com (the “Organizer”).

2. Purpose
The purpose of this giveaway is to promote the DISTINCT brand and its products through Instagram.

3. Territorial Scope
The giveaway is open to individuals residing in Europe.

4. Giveaway Period
The giveaway starts on 15 of March 2026 at 00:00AM (Madrid, Spain time) and ends on 22nd of March 2026 at 15:00 (Madrid, Spain time).

5. Eligibility
Participants must meet all of the following requirements:
a) Be at least 18 years old at the time of entry.  
b) Have a real and active Instagram account.  
c) Complete the participation steps described in Section 6 within the giveaway period.  
d) Reside within the territorial scope stated in Section 3.

Employees of the Organizer, collaborators directly involved in this giveaway, and their immediate family members may not participate.

6. How to Enter
To enter the giveaway, participants must:

1. Follow @bydistinctdesigns on Instagram.  
2. Follow @kellylrh on Instagram.  
3. Comment on the official giveaway post stating **which design they would choose from the DISTINCT website**.

Each participant may submit **[one / multiple]** valid entry/entries, provided that each comment is different and genuine.

Entries will not be accepted if they are:
- submitted after the closing date,
- made through fake, duplicate, or suspicious accounts,
- offensive, unlawful, or inappropriate,
- or otherwise in breach of these Terms and Conditions.

7. Prize
There will be three (3) winners.

Each winner will receive:
- one (1) tribal helmet decal from DISTINCT,
- chosen from the designs currently available on the Organizer’s website.

The prize:
- is personal and non-transferable,
- cannot be exchanged for cash or any other alternative,
- does not include any product, service, or feature not expressly described in these Terms and Conditions.

The Organizer reserves the right to refuse a design choice if it is discontinued, unavailable, or technically unsuitable, in which case the winner will be asked to choose another available design from the website.

8.Winner Selection
The three (3) winners will be selected at random from all valid entries after the giveaway has ended, using **[random app / random draw / giveaway tool]**.

The Organizer may also select two (2) alternate winners in case any selected winner:
- does not respond within the required timeframe,
- does not meet the eligibility requirements,
- declines the prize,
- or is disqualified for any reason.

9. Winner Announcement and Contact
The winners will be announced on 22nd of March 2026 via Instagram Post.

The Organizer will contact each winner by Instagram direct message. Each winner must reply within 48 hours of the message being sent.

If a winner does not reply within that period, declines the prize, or fails to prove eligibility, the Organizer may assign the prize to an alternate winner.

10. Prize Delivery
The prize will be delivered once the winner has been verified and has provided all information necessary for delivery, including full name and shipping address.

The Organizer shall not be responsible if delivery cannot be completed due to incorrect, incomplete, or false information provided by the winner.

11. Disqualification and Reservation of Rights
The Organizer reserves the right to:
- disqualify fraudulent or invalid entries,
- remove participants acting in bad faith,
- amend, suspend, or cancel the giveaway for justified reasons,
- verify the validity of entries and participant eligibility.

The Organizer shall not be liable for any interruption, delay, technical failure, Instagram malfunction, network issue, or other circumstance beyond its reasonable control that may affect participation or the operation of the giveaway.

12. Data Protection
Any personal data provided by the winners will be processed by DISTINCT DESIGNS STUDIO, S.L. solely for the purpose of:
- managing the giveaway,
- contacting the winners,
- and arranging prize delivery.

The legal basis for this processing is the administration of the giveaway and the winner’s consent when voluntarily providing the required data for prize fulfillment.

The data will be kept only for as long as necessary to manage the giveaway and comply with applicable legal obligations.

Participants may exercise their rights of access, rectification, erasure, objection, restriction of processing, and portability by contacting info@bydistinct.com.

Personal data will not be shared with third parties unless necessary for prize delivery or required by law.

3. Winner Identification
The winners agree that their Instagram usernames may be published by the Organizer solely for the purpose of announcing the result of the giveaway.

Any additional use of the winners’ image, content, photographs, videos, or testimonials will require separate prior consent.

This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram.

By participating, entrants fully release Instagram from any responsibility related to this giveaway.

15. Acceptance of These Terms
Participation in this giveaway implies full acceptance of these Terms and Conditions.

16. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by Spanish law.

Any dispute arising from the interpretation or application of these Terms and Conditions shall be submitted to the courts and tribunals competent under applicable law.
